A reporter for The Park Record newspaper has filed a lawsuit saying she was sexually assaulted by the paper's former publisher and infected with herpes simplex.

Jennifer Madgic of Park City filed the lawsuit in 3rd District Court claiming that Jan Wilking of Park City sexually assaulted her. An attorney representing Wilking said the claim was without merit.Wilking, a former Park City councilman, sold the newspaper several years ago. The lawsuit, filed Oct. 10, said the alleged incident took place June 2. No criminal charges have been filed.

The suit claims there was "an unprovoked and unwelcome sexual attack, and includes but is not limited to, sexual intercourse itself."

The action, which seeks unspecified monetary damages, alleges Wilking "recklessly, negligently and in violation of his duty of due care to plaintiff, infected plaintiff with a communicable disease, to wit: sexually transmitted herpes simplex."

The document claims that Madgic has "suffered severe bodily injuries; has suffered substantial impairment and disability; has experienced severe mental, emotional and physical pain and suffering" as a result of the alleged assault.

An attorney representing Wilking called the claims false and said his client will "vigorously defend" himself.

"We absolutely, categorically deny the claim," said Richard Burbidge.

He said Madgic had sought "a lot of money" to settle the claim out of court, but Wilking had refused and was considering counterclaims.
