Morgan County has appealed the reversal of its decision to fire former sheriff's deputy Dan Schofield.
County Attorney Dwight King said he and Sheriff Bert Holbrook disagree with a special termination appeals board's 2-to-1 decision last month that Schofield's termination was unjustified.King said the county's appeal will be heard by 2nd District Judge Douglas L Cornaby. No hearing date was immediately set.
The deputy was put on paid suspension by Holbrook on Feb. 15 after the sheriff accused him of falsifying daily logs, weekly time sheets and overtime slips.
On April 28, Morgan County stopped paying Schofield, and Schofield claimed he was terminated without ever having had a pre-termination hearing. He appealed to an appointed county board. That board decided in favor of Schofield on Oct. 2.
