A Kanab man has been bound over to 6th District Court on a second-degree murder charge in connection with the Aug. 10 fatal shooting of another man.

Lew Day, 42, Kanab, will be arraigned at 9 a.m. Dec. 7. He is accused in the death of David Keith Kyle, 40, Escalante, Garfield County.Lewis Sudweeks, a witness for the state, related during a Thursday preliminary hearing how an all-day drinking party abruptly ended when it turned into tragedy. One friend had been shot, another arrested, and he himself had heard shots and saw puffs of gravel from bullets erupt at his feet while running away from the scene.

Day was held in the Sevier County Jail until mid-October. He was released from custody when a friend posted property titles that were valued at more than $100,000. He will remain free on bail until the arraignment.
