Former Chicago Bears running back Walter Payton was negligent when he accidentally shot the manager of his suburban restaurant in the knee last year, the manager alleged in a lawsuit.

The suit contends that Payton was in the office of Studebaker's restaurant in suburban Schaumburg on April 13, 1988, handling a French-made 9 mm semi-automatic pistol when it fired and hit manager Elmer Ray Hutson in the knee.Neither Payton nor his attorney, Paul Holmes, could be reached for immediate comment. The lawsuit seeks in excess of $15,000 in damages from the former Bears running back but under law does not name an actual amount.
