MISTRIAL IN KIDNAP CASE

A judge declared a mistrial late Friday in the kidnapping and sexual abuse trial of Thomas C. Headley after a "hopelessly deadlocked" jury said it could not reach a verdict.

After nearly 10 hours of deliberations, foreman Robert Bartlett informed 1st District Judge Gordon Low at 9:37 p.m. that the two-woman, six-man panel was at an impasse.Headley, 31, was charged with child kidnapping, aggravated sexual abuse of a child and aggravated kidnapping.

Frank Harvey, 47, Elmo, Wash., was convicted of the same crimes in August 1987 but was released from prison four months later after authorities said they had found new evidence implicating another suspect.
