A Ute leader defeated in a recall election is seeking a tribal court order that would allow her to retain her seat on the governing Business Committee until and if the election is declared legal and proper.

Irene Cuch on Tuesday asked the tribal court for a temporary restraining order and injunction barring three other members of the Business Committee from declaring her seat vacant.Cuch contends the acceptance of unverified results of Friday's election by Tribal Chairman Luke Duncan, Stewart Pike and Curtis Cesspooch denied her due process and equal protection as a result of an improper and unlawful process.

Cuch maintains she should not be ordered to vacate her office and relinquish her title because the election results have not been certified or accepted by a quorum of the Business Committee. She also claims signatures on recall petitions were not properly verified prior to the election.
