SHARE FIRM TO APPEAL SUIT AGAINST RESORTS

United Park City Mines will appeal a decision by 3rd District Judge Pat B. Brian dismissing a lawsuit filed by United Park City Mines Co. in 1986 against the operators of the Park City and Deer Valley ski resorts.

David W. Bernolfo, UPCM president, said, "We are advised and believe that the court's decision is in error and intend to vigorously pursue United Park's rights on the appeal. The board of directors will meet within the next week to review these rights and other options available."In the lawsuit, UPCM alleged that its two former controlling shareholders, Atlantic Richfield Co. and ASARCO Inc., two eastern banks and two ski resorts breached their fiduciary duties in connection with the 1975 restructuring of Greater Park City Co., the company to which United Park has been sold and leased various surface acreage, water rights and the Park City Ski Resort.
