North Carolina State has been empowered by the governing body of the state's university system to sue if necessary to terminate the contract of basketball coach Jim Valvano.

But a Valvano lawyer questions whether the university has the evidence to win a breach of contract suit. The lawyer, Woody Webb, said it is clear the university wants to sever ties with the coach and, to that end, said he would "focus on the monetary aspects of the situation.""He's hopeful that we can negotiate the situation out," Webb, a Raleigh lawyer, said. "As I understand it, there's no desire by the university to go running into court right now."

The News and Observer of Raleigh, attributing its report to unnamed sources, said legal proceedings probably would be initiated by the end of the week unless Valvano agrees to step down.
