One of four Utah County men facing rape and sodomy charges involving a 14-year-old girl was bound over for trial Friday following a preliminary hearing before 4th Circuit Judge Robert Sumsion.
Patrick Burt, 25, Provo, will be arraigned July 6 in 4th District Court on one count of rape of a child and two counts of sodomy of a child. The charges - first-degree felonies that carry minimum mandatory terms of five, 10 or 15 years in prison - stem from incidents alleged to have occurred between March 1 and April 30.Burt was charged as a result of an investigation that began in April after a Draper policeman reported witnessing Maurice C. Smith, 61, Pleasant Grove, engaged in sex acts with the girl in a van parked off a frontage road near Point of the Mountain. Smith, also charged with rape and sodomy of a child, faces a preliminary hearing July 25 in American Fork.
A third defendant, Jack W. Johnston, 55, Moroni, also is awaiting preliminary hearing in American Fork on charges of sexual abuse of a child and rape and sodomy of a child in connection with incidents alleged to have occurred July 17, 1989, in American Fork when the girl was 13.
The victim, erroneously reported to be slightly retarded, is under observation at the Utah State Hospital.
The fourth defendant in the case, William O. Hayes, 64, American Fork, faces charges of aggravated sexual abuse of a child, a first-degree felony, and attempted rape of a child, a second-degree felony.
