A drug suspect who pleaded guilty to conspiracy charges cannot withdraw the plea or change its terms, a Utah federal judge has ruled.

James P. Johnson's attorney said his client had the equipment and ingredients, "but he didn't have the ability to manufacture methamphetamine" and should have been charged with "a far less serious offense."But federal prosecutor Wayne Dance said Johnson, 41, Salt Lake City, "knowingly and voluntarily" agreed last March to plead guilty to allegations of conspiracy to manufacture the drug.

Judge David Sam agreed with the prosecutor, ruling he could find "no basis to allow the defendant to withdraw the plea."
