A reporter's non-confidential material gathered at a news event is not considered privileged information covered under the First Amendment and can be subpoenaed for use in court, an appeals court ruled.

The 2-1 decision Thursday by the Michigan Court of Appeals supported an insurance company's demand that it be allowed to obtain unpublished photographs of a fire taken by a photographer for the Ann Arbor News.The insurer, American Employers Insurance Co., subpoenaed the photos in its defense in a civil case in which it sought to prove that arson was the cause of the 1986 fire at Mark Video Enterprises Inc.
