A 15-year-old boy was charged late Thursday with first-degree felony aggravated murder in the Oct. 23 strangling of a 5-year-old Layton girl.

Weber County Attorney Reed Richards said he decided on the aggravated murder count, which carries a possible death sentence, after evidence showed Bobbie Jo Hart had been sexually assaulted.He declined to provide further details, except to say he has filed a motion with 2nd District Juvenile Court seeking certification of the suspect as an adult for trial.

The defendant will be arraigned before a juvenile judge sometime in mid-November, he said.

The victim was reported missing from her grandfather's central Ogden neighborhood a week ago. Her body, inside a plastic bag stuffed into a trash can behind the suspect's home, was found Saturday.

The suspect, an Ogden High School student, is expected to undergo psychiatric testing.

Police at first labeled the Hart slaying a "copycat" of an Oct. 13 strangling of a 10-year-old girl in nearby Roy but later ruled out that motive.

"It's not a copycat, it's more of a coincidence," said Ogden Police Capt. Marlin Balls.
