MOTION TO WITHDRAW GUILTY PLEA DENIED

A 1st District judge has denied a motion by a former Wellsville resident to withdraw his guilty plea on a child sexual abuse charge involving a 14-year-old member of an Ogden polygamist sect.

Judge Gordon Low denied the motion Monday and ordered Mark Lichfiedl to undergo a 90-day diagnostic evaluation at the Utah State Prison before being sentenced.Defense attorney Doug Brady argued the guilty plea should be withdrawn because he said the public defender provided ineffective counseling before Brady took over in early February.

Lichfiedl, now a resident of north Ogden, pleaded guilty to the third degree felong on December 23 as part of a plea agreement with the Cache County Attorney's Office.

Brady said Lichfield was not a member of the polygamist sect.
