COURT ALLOWS N-TEST WORKERS TO SUE THE U.S.

A federal appeals court says 220 workers at the Nevada nuclear testing grounds can sue the government over radiation injuries they say they received from 30 years of Cold War bomb tests.

The workers alleged in a lawsuit that they were exposed to dangerous levels of radiation and that the government didn't provide protective clothing, failed to monitor radiation levels and didn't warn them of health dangers.The government had asked that the lawsuit be dismissed, arguing that federal law shields it from lawsuits filed over actions taken at the discretion of federal employees.

But a three-judge panel of 9th U.S. Circuit Court of Appeals ruled unanimously Tuesday that the government's claim of immunity can be resolved only in a trial.
