The National Park Service is seeking an injunction against road work being done by Kane County within the Glen Canyon National Recreation Area.
The park service claims the county is not authorized to upgrade Warm Creek Road within the park's boundaries.County commissioners contend the county has exclusive rights regarding the road.
The County Commission has allocated $240,000 to pay for a chip and seal coat over gravel on the dirt road.
The county calls the work maintenance and the Park Service calls it paving.
Larry May, assistant superintendent with the National Park Service, said his agency would agree to let the county gravel the two-mile section but balks at the chip and seal coats.
