Two lawsuits were filed Monday in 4th District Court against a former Payson dentist who pleaded guilty to five felony charges and whose license was revoked in April.

Paula Meredith, and David and Judy Heaton filed suits against John W. Day claiming dental work performed on them by Day was "negligent and improper."Day, 35, pleaded guilty last month to two counts of communications fraud, two counts of filing false or fraudulent insurance claims and one count of racketeering. He is scheduled to be sentenced June 16 and could get one to 15 years in prison.

In April, Day surprised Utah Division of Professional Licensing officials when he asked to have his license revoked just prior to a review hearing on allegations of misconduct.

In her suit, Meredith claims other dentists informed her that dental and orthodontic work performed by Day from 1989 to 1991 was careless. To correct damage caused by Day, she will incur medical and dental expenses in excess of $5,000, Meredith claims.

Meredith also claims she has suffered excruciating physical and mental pain, disfigurement and impairment and has had permanent loss of function because of Day's wrongful care. She is asking for general and special damages to be proven at trial.

The Heatons are claiming that Day billed them and their insurance company for work that was not performed. They claim Day used unsanitary practices and failed to clean instruments. They also claim Day did improper cleaning, root canals, teeth extraction and placement of caps and crowns. On one occasion Day drilled a hole through two front teeth of one of their children, the Heatons said in their suit.

The Heatons also are seeking special and general damages to be proven at trial.
