If HB107 passes, the state Tax Commission had best do its homework before it accuses someone of not paying taxes.

The bill, which was filed last week, would require the state to pay the legal and accounting fees of those who win a tax dispute with the Tax Commission.Rep. Jeff Alexander, R-Provo, the bill's sponsor, said someone could recover fees only if the dispute goes to a resolution hearing, and not if the matter can be settled informally.

He expects the Tax Commission to push for an amendment that would keep accountants from being overinclined to use litigation by requiring those who lose their tax fight with the state to pay the state's costs.
