The attorney for a Smithfield man charged with aggravated kidnapping in a failed 1991 bank extortion case believes his client is incompetent to stand trial.

Lawyer David Perry, in documents filed last week in 1st District Court, claims 20-year-old Robert Smith is unable to rationally discuss the case with him.Smith faces first-degree felony charges of aggravated kidnapping, aggravated robbery, aggravated burglary, and misdemeanor auto theft for his alleged role in the extortion attempt.

He and a 16-year-old accomplice were arrested last month on a tip to police.

Police claim the pair broke into the home of a Smithfield bank manager in December 1991 and ordered his wife at gunpoint demand that he bring home cash.
