Ginger Rogers, who moved so gracefully during her dancing career, was unable to work out the kinks in a deal to settle an invasion of privacy lawsuit she filed against a card company.

So the 81-year-old Rogers wants to take Portal Publications of Corte Madera, Calif., to court in September, her lawyer, Edward Marion, said Friday.Rogers of Rancho Mirage, Calif., sued the company last fall after discovering her likeness on a $2 birthday card at a Madison bookstore.

Marion declined to reveal details of the settlement and said he didn't know why it collapsed. He said she'll ask a judge for a trial date the week of Sept. 13 because she'll be in Wisconsin for a Ginger Rogers film festival.
