The City Council voted to authorize the acquisition of property to build a railroad spur to the Nephi Industrial Park and adjoining property.
"The construction of a railroad spur is a public use for which Nephi City has the power of eminent domain to acquire real property or a right-of-way," states the resolution.The council, or the city staff, has the right to either acquire by purchase or by exercising eminent domain, all or a portion of the necessary property required to complete the railroad spur project.
Mayor Robert Steele said the spur was a definite improvement to the city industrial park.
The resolution recognizes Nephi city as the owner of the industrial park and a piece of property located immediately east of the north portion of the park. Since the project will serve the park and the interests of the public, the city can exercise eminent domain.
Legal descriptions of the properties involved are available at city hall. Two portions of property are involved, said Randy McKnight, city administrator.
