Prosecutor Marcia Clark misled the judge in the O.J. Simpson trial when she said she couldn't attend a night session because she had to take care of her two sons, her estranged husband claims.
In court papers filed in the Clarks' divorce case, Gordon Clark said he was to pick up their sons that night and take care of them.He said Marcia Clark canceled the original plan and later brought the children to him at 8:45 p.m. He said that even if his wife had worked late, a live-in housekeeper could have cared for the boys, ages 3 and 5.
"Clearly, Marcia Clark does not have any child-care problems," Gordon Clark said. "Any such implication is not accurate, misrepresents the actual facts and does a disservice to me and our children."
Because of Marcia Clark's claims, Judge Lance Ito postponed testimony of key defense witness Rosa Lopez until Feb. 27. Defense lawyers had wanted her on the stand Feb. 24.
One of Marcia Clark's divorce lawyers denounced the allegations.
"Marcia Clark has an impeccable professional reputation and record, and any allegations to the contrary by Mr. Clark are outrageous and completely untrue," Mark Fleischer said.
The Clarks have been separated for the past year, and both are seeking custody of their children, who now live with Marcia Clark.
Lopez testified for three days on videotape last week. She says she saw Simpson's Bronco outside his home at the time prosecutors say he drove it to his ex-wife's house to kill her and her friend.
