A Bountiful woman will be sentenced Oct. 10 after pleading guilty this week in 2nd District Court to having oral sex with her foster son, who she met while he was her student at Northwest Middle School in Salt Lake.

Donna J. Martinez, 39, pleaded guilty to the first-degree felony charge of forcible sodomy in return for having three other related first-degree felony charges dismissed.According to court records, Martinez met the boy, then 13, while she was teaching industrial arts at the school. She eventually gained custody of the boy and he moved into her Bountiful home in January 1994, according to prosecutors.

The sexual encounters occurred in her home between January and March of 1994, according to court records, but Martinez said in court this week that the one incident she pleaded guilty to did not occur until the fall of last year, when the victim was 14.

Under Utah law, that would lessen the penalty on the crime although Martinez still faces some enhancement because she was the boy's teacher, which the law defines as someone being in authority or occupying a position of trust.

Defense attorney Terry Cathcart said he will present Martinez's psychologist as a witness at the sentencing hearing. Martinez faces from five years to life in prison on the charge.
