No charges will be filed against an 11-year-old boy who fatally shot his 7-year-old sister on Nov. 14, Utah County Attorney Kay Bryson has decided.

Bryson said Tuesday there was no evidence that the shooting was anything but accidental."There is really no purpose to be served in pursuing the matter based on the negligent act of an 11-year-old boy," he said.

The case was referred to Bryson after authorities learned that the boy's story was inconsistent with autopsy findings regarding his distance from the victim at the time of the shooting.

Police turned the new information over to the county attorney's office last Friday.

The boy reportedly found the gun in a cabinet above a refrigerator. Thinking the gun was unloaded, he went into the parents' bedroom where his sister was coloring and shot her, police said.

The children were home alone while their parents were at work.

Family members said the 11-year-old pointed the gun at the girl to tease her.
