Judge sides with grandma who robbed Indian casino

A 61-year-old grandmother who robbed an Indian casino at gunpoint has escaped jail time because a federal judge ruled the casino was a "criminal enterprise" at the time of her heist.

U.S. District Judge James Parker said Thursday that Loretta Martinez should serve five years probation rather than go to prison and that she need not repay the Camel Rock casino near Santa Fe for the full $7,000 she stone on April 21."The pueblo's unlawful conduct contributed significantly to provoking wrongful conduct of Ms. Martinez," Parker said at the sentencing hearing. "I find the amount of the loss is miniscule compared to the profit derived from its gaming activities."
