Metallica settled out of court with a concertgoer who sued the heavy metal band, a development that was music to the judge's ears.
"The good news for me is that I don't have to watch the tape of a 2 1/2-hour Metallica concert tonight," Judge Patrick Grady told jurors the same day the lawsuit went to trial.The agreement came after a short break in the trial Monday.
Todd Miller, 26, of Chicago sued the band over injuries he claimed he suffered during a concert at Carver-Hawkeye Arena in Iowa City in 1993. He alleged he was picked up against his will, passed through the crowd and then dropped on his head. His injuries included a permanent loss of the sense of smell, his lawsuit said.
Details of the settlement were kept confidential, though all of the parties - including Miller - said they were pleased with the outcome.
Miller also sued the state, which owns the arena. University spokeswoman Gay Pelzer said the state was part of the settlement but declined to give details.
