A man who pleaded guilty to shooting his father to death on Christmas Day was ordered to serve 18 months probation.
Jon Todd Poore, 32, must also pay a $2,000 fine for the death of his father, Jack L. Poore, 56. Third District Judge Phillip K. Palmer said he felt the case did not warrant prison time for the younger Poore.The man spent most of Christmas Day 1996 arguing with his father. About 9 p.m., things became physical when Jack Poore shoved his son, and the son slapped his father in the head. Moments later, Jack Poore emerged from his bedroom with a 20-gauge shotgun, police said.
The two wrestled with the gun and it went off when Jon Poore grabbed the barrel, blasting the older man in the chest, according to charges filed in 3rd District Court.
Jon Poore was charged with manslaughter because he was bigger and stronger than his father and was not in any real danger of being shot, according to prosecutor Katherine Bernards-Goodman.
"On the other hand, there was a pretty good claim of self-defense here. The father is the one who got the gun," she said.
Jon Poore pleaded guilty to negligent homicide.
