A former Myton man who was convicted of murder in 1978 is going back to prison for burglarizing a house near Duchesne.

James W. Summarell III, 42, Sandy, was sentenced in 1979 to five years to life in the Utah State Prison for killing 24-year-old Leonard J. Walker, who walked in on Summarell burglarizing his home in Ioka. Summarell was paroled in 1991 after serving 11 years.Jack Ford, Utah Department of Corrections public information officer, said Summarell completed parole in 1993 but was sentenced to another prison term in 1995 for theft. He was paroled last September and successfully completed an electronic monitoring program.

But on May 24 officers arrested him for the burglary of a home near Strawberry Cemetery. Duchesne County sheriff's deputies recovered a stolen gun, knife and coins from Summarell.

Summarell was 22 when he was charged with the first-degree homicide. Walker was a Montana native who had been working in the oil fields in Duchesne County for about a year. His body was found in an irrigation ditch in a field south of his home. He had been shot twice in the back of the head with his own gun after he walked in and surprised Summarell as he was burglarizing his home.
