ROOSEVELT -- Saying the statute of limitations had expired on eight of the 12 sex abuse charges leveled against a Roosevelt businessman accused of molesting relatives and a Boy Scout in his charge, prosecutors opted for a plea agreement with Richard F. Fisco Sr.
Fisco, 63, appeared in 8th District Court in Roosevelt Thursday, April 13, and entered guilty pleas to two reduced charges of 2nd degree felony sexual abuse of a child. In return for his guilty pleas, the two remaining charges that had not expired were dismissed. Fisco had initially been charged by Duchesne County Sheriff's Office with seven first-degree felony counts of aggravated sexual abuse and rape of a child, as well as five misdemeanors for lewdness with children and adults.The new charges do not carry minimum-mandatory sentencing, but as part of the plea agreement, the sentences on the two charges are to be served consecutively, rather than concurrently. A second-degree felony carries a possible term of 1-15 years in prison and a possible $10,000 fine.
A sentencing date is pending an April 25 status heating in Vernal.
Fisco has been incarcerated in the Duchesne County jail since October 1999, when he was arrested at his downtown Roosevelt pawn shop. Throughout the investigation he was cooperative with prosecutors, to the point of providing them with information they did not have on his history.
