CEDAR CITY — The two teens accused of killing Cynthia Kay Boggs smoked marijuana with her in her mobile home and joked about killing Boggs, 36, for her cache of drugs just three days before her death, a witness testified Wednesday at a preliminary hearing for one of the teens.

Fifth District Judge Robert Braithwaite also heard testimony from Boggs' husband, a state medical examiner, state fire marshal, Cedar City sheriff and detectives and the last person to see Boggs alive before her Jan. 30 death.

At the conclusion of the three-hour preliminary hearing, Braithwaite ordered Carl Gary Wilcken, 18, to stand trial on one count of capital murder and aggravated arson and aggravated robbery, both first-degree felonies.

Iron County Attorney Scott Burns has said he may seek the death penalty for Wilcken. He has until Wilcken's trial, estimated to begin within the next six months, to make a final decision.

Zachary Russell Beatty, 17, waived his preliminary hearing and will be arraigned April 2 for murder, aggravated arson and aggravated robbery, all first-degree felonies.

Wilcken and Beatty are being held without bail.

The teens are accused of shooting Boggs multiple times Jan. 30, dumping her body about three miles away and then burning her trailer to the ground.Guns and drugs were stolen from Boggs' home, Burns said.

Boggs' husband, John Boggs, was arrested shortly after the fire on unrelated drug charges. He pleaded guilty to one count of distribution of marijuana and will be sentenced March 27. John Boggs is not a suspect in his wife's slaying.
