Software giant Oracle Corp.'s chief executive, Larry Ellison, has lost the latest round in his bid to be allowed to land his $40 million jet in San Jose, Calif., after the city's landing curfew.

Airport officials in San Jose Friday denied the request by Ellison, 57, for permission to land his Gulfstream V jet at the San Jose International Airport between 11:30 p.m. and 6:30 a.m., the San Francisco Chronicle reported Saturday.

The decision means lawyers for San Jose, Ellison and Wing and a Prayer Inc., the company that operates the plane, will be back in U.S. District Court in San Jose on April 9 to argue a civil lawsuit challenging the city policy.
