Two men have been charged with rape, a first-degree felony, in connection with an incident in which both men allegedly had sex with a 15-year-old girl after she passed out.
Charges filed Friday in 3rd District Court state the men, ages 18 and 21, took the girl to a Salt Lake motel after a barbecue May 26 where she had been drinking.
The girl's cousin, her cousin's boyfriend and three other men were at the motel at the time. Charges state one man watched the two defendants allegedly having sex with the victim and told them to stop, but the defendants replied it was "OK because she was passed out."
One defendant is in jail. Court documents state that when an officer attempted to locate the other man at his work, he was informed the man had fled after learning police were looking for him.
If convicted, each man faces up to life in prison and a $10,000 fine.
