A federal judge has eliminated all but one of the defendants in a Bountiful man's lawsuit over an October 1999 traffic stop.
U.S. District Judge Tena Campbell last week dismissed the West Bountiful Police Department from the suit. Campbell previously dismissed West Bountiful city and two individual police officers from the suit, as well as all claims by the man's grandson, Kyle Webb.
Only one former Bountiful officer, Jamie Wehner, remains in the lawsuit.
Dale Noorda and Webb were on their way to the city dump on Oct. 4, 1999, in separate vehicles when Webb was stopped by police. Noorda also stopped and asked why his grandson had been pulled over.
Noorda says officers slammed his upper body and face against the trunk of a police car, sprayed him with pepper spray, threw him to the ground and hog-tied him.
Noorda was criminally charged in connection with the incident and pleaded guilty to disorderly conduct, a class C misdemeanor, and paid a $280 fine.
Wehner resigned in February 2000 after he was investigated after items were taken from the department's evidence room. Wehner pleaded no contest to one count of wrongful appropriation, a class A misdemeanor.
