Court upholds dismissal of lawsuit challenging war

BOSTON (AP) — A federal appeals court on Tuesday refused to reconsider its decision to dismiss a lawsuit challenging President Bush's authority to launch a war against Iraq.

The lawsuit was filed last month by three unnamed U.S. servicemen, parents of servicemen and six Democratic congressmen. They claim that Bush needs a formal declaration of war from Congress before attacking Iraq.

Although Congress authorized the use of force with Iraq in an October resolution, the lawsuit claims it has not specifically declared war as required by the Constitution.
