The Utah Court of Appeals on Thursday affirmed the murder conviction of Frank Lyle Dominguez.

Dominguez was convicted last year of first-degree murder for the October 2000 killing of shopkeeper Waleed Mohammed E-Alawneh in Ogden's Boulevard Market. Dominguez was sentenced to up to life in prison.

He claimed numerous errors were made during his trial, including allowing testimony about a threat he made to a prison guard. Dominguez argued prosecutors "flooded the jury with extraneous and damaging information" by presenting evidence about the incident.

The appellate court, however, affirmed the jury conviction. Second District Judge W. Brent West, the opinion stated, did not abuse his discretion in a pretrial ruling that allowed limited testimony about Dominguez' parole and prison status.
