PROVO — A Delaware court has dismissed a derivative lawsuit related to Nu Skin Enterprises Inc.'s acquisition of Nu Skin International and other affiliated entities in 1998 and 1999.
The Delaware Court of Chancery granted the company's motion to dismiss the lawsuit.
After the derivative action was filed in January 2000, the Nu Skin board appointed a special litigation committee to investigate the complaint's allegations. The company moved to dismiss the suit after studying the committee's findings.
Truman Hunt, president and chief executive officer, said the committee "determined that the transactions were fair to the company and its stockholders. The court's decision validates their findings."
The court's decision to grant the motion to dismiss remains subject to the plaintiff's right to appeal.
