PROVO — Louis Darrell Kinyon, charged with capital murder in the death of his boss on Feb. 2, is scheduled to appear before a 4th District judge on Sept. 22 for a waiver hearing.

American Fork resident Kinyon, 49, had a scheduling conference before Judge Davis on Wednesday, where his attorneys said they need the time to review some additional medical information.

Police allege Kinyon, who worked at the Provo River Water Users Association, went to his workplace to talk with Griffith, a supervisor. Kinyon had been suspended from his job the previous week

Police say an angry Kinyon left the meeting and returned a short time later with a handgun. He chased co-workers before fatally shooting Griffith, police say.

Kinyon then walked into a rest room and shot himself, police say.

Kinyon spent nearly a month in the hospital before being booked into the Utah County Jail on Feb. 27. He is being held without bail.
