PROVO — The defense attorney for a Springville man accused of kidnapping a Provo girl said there is evidence that proves his client was not at the scene when police say the alleged crime occurred.
"He was in Salt Lake at the time this offense, rather," said Dana Facemyer, lawyer for Jimmy Guard, 26.
He's in the process of securing alibi evidence to introduce in the case.
Guard is accused of the first-degree felony charge of child kidnapping after he allegedly grabbed a young girl in February and tried to get her to come with him.
He faces other similar charges, too. He's charged with attempted child kidnapping and attempted sodomy on a child after he allegedly tried to lure two Springville girls into his car in July 2004.
