Affidavit of Steven G. Adams
In support of an
ARREST WARRANT
CASE NUMBER: 061400237
I, Steven G. Adams, being first duly sworn on oath, depose and say:
1. I am a police officer with 20 years experience. I am currently employed by the city of Spanish Fork, Utah, and hold the rank of lieutenant. The information provided was gathered though personal interviews and sworn testimony.
2. I am currently assigned to investigate the disappearance of Kiplyn Davis, who disappeared on Tuesday, May 2, 1995 from Spanish Fork High School at approximately 1300 hours. At the time of her disappearance Kiplyn was 15 years old.
3. On Tuesday May 2, 1995 at around 2350 hours, Richard Davis reported that his daughter, Kiplyn, had not returned home from school. Kiplyn was dropped off at the Spanish Fork High School for drivers education at around 0540 hours.
4. Richard and Tamara Davis searched the area and Spanish Fork High School for Kiplyn Davis. Citizen Informant CM was contacted by the Davis family and stated that he saw Kiplyn with Chris Jeppson at the school during school hours. Tamara had Citizen Informant CM call Chris Jeppson. Citizen Informant CM called Tamara back and said he spoke with Chris Jeppson's sister, Citizen Informant DH, and she stated that Chris was at play practice being held at the high school. At around 2330 hours, Citizen Informant CM called Chris Jeppson's home again and found him just walking in the door. Rucker Leifson and Tim Olsen were with him.
5. On May 3rd, 1995, Haley Davis, Kiplyn Davis' older sister, went to the high school to check Kiplyn's locker. She found Kiplyn's purse with several personal items that she would normally not leave behind.
6. Tim Olsen was interviewed by the authorities and has changed his story of his whereabouts on May 2nd, 1995 several times. On September 6th, 1996, Tim Olsen provided a false alibi of his whereabouts on May 2nd, 1995, stating that he was working all day with Scott Brunson on a shed at his family home.
7. Three days later on September 9th, 1996, Tim Olsen provided a false alibi of his whereabouts on May 2nd, 1995, stating that it was raining, he met his girlfriend, Citizen Informant MA, and then they went to Scott Brunson's house and helped Scott Brunson shingle a shed until around 2100 hours and then went to Chris Jeppson's house.
8. On September 20th, 2004, Scott Brunson was interviewed by Agent Anderson and your Affiant. Scott Brunson indicated that Tim Olsen came to him on several occasions to provide Tim Olsen with an alibi for the day of Kiplyn Davis' disappearance. Scott Brunson stated that Tim Olsen requested a false alibi that he had worked on a shed all day on May 2nd, 1995, the day Kiplyn Davis disappeared. Tim Olsen also stated if anybody asks I was with you all day. Scott Brunson provided Tim Olsen with the false alibi but admits Olsen was not working on the shed that day.
9. Tim Olsen provided a second false alibi regarding his whereabouts on May 2nd, 1995, along with Chris Jeppson and Rucker Leifson. Tim Olsen and Rucker Leifson stated they were at the Spanish Fork High School auditorium helping Chris Jeppson with the set up for a production at the school and throwing a football and frisbee in the auditorium. Records indicate that at the time Olsen, Leifson and Jeppson stated they were at the auditorium, a choir concert was ongoing at that specific time, they therefore could not have been in the auditorium throwing a football or setting up for a production.
10. Lieutenant Brad Stone indicated that he is part of the Spanish Fork Community Choir. On May 2nd, 1995 there was a concert at the Spanish Fork High School in the Large Auditorium. Citizen Informant CS was the director of the choir and indicated to Your Affiant that the concert was scheduled to start at 1930 hours. He indicated that he would have been to the school around 1630-1700 hours to start setting up for the concert. He also indicated that after the concert was over, they had cleaned up and left the school around 2230 hours and at no time did they see Tim Olsen, Chris Jeppson or Rucker Leifson.
11. On April 3rd, 2003 Citizen Informant CB was interviewed by your Affiant and stated around 1997-98 he was at a party in Springville where he overheard Tim Olsen and another individual talking. Citizen Informant CB overheard the individual saying they were going to get caught and that they were in trouble. Tim Olsen was telling him to calm down, they were not going to get caught, it's been a long time, don't say anything to anyone. Citizen Informant CB also heard them talking about a truck box and the train tunnels. The box was the one Tim used to have in his old blue Ford. Citizen Informant CB believes from what he heard that they were talking about Kiplyn Davis.
Citizen Informant CB also stated that he had been called by Tim Olsen, that Tim Olsen wanted to come to his house in Spanish Fork. Tim Olsen came to his house and was visibly upset and had been drinking. Tim Olsen told Citizen Informant CB that the police and the FBI were after him, that "I did it, I did it," I raped, killed and buried Kiplyn Davis.
12. In July of 2003 Citizen Informant CD was at a party wherein Tim Olsen admitted to her and others that he knew Kiplyn Davis was buried by the tunnels in Spanish Fork Canyon. In addition, Tim Olsen admitted to Citizen Informant CD that "I killed her and buried her under the train tracks."
13. In July of 2003 Citizen Informant MJ was at a party wherein Tim Olsen admitted to her and others that he had killed Kiplyn Davis and buried her near the tunnels in Spanish Fork Canyon.
14. On November 3rd, 2004 Citizen Informant SP was interviewed by Your Affiant and stated that Tim Olsen had said the following things. "I can make someone disappear, I've done it before," "I did it once I can do it again," "I'm the only one involved in Kiplyn Davis' disappearance." Tim Olsen admitted to Citizen Informant SP that he sluffed with her, beat her and disposed of her body.
15. On December 20th, 2004 Citizen Informant DM was interviewed by Agent Anderson and your Affiant and stated he was a former employer of Tim Olsen. Citizen Informant DM informed Affiant that Tim Olsen admitted to burying Kiplyn in a sandy grave because she would sink to the bottom. This conversation was while they were at work.
16. On June 20th, 2005 Citizen Informant PL and EL were interviewed by your Affiant and Agent Anderson. Citizen Informant PL remembers seeing Chris Jeppson and two or three friends at her mothers' home around the time Kiplyn Davis disappeared. They said they were looking for flash lights to look for a class mate that had disappeared, prior to the time Kiplyn Davis was reported missing.
17. In October, 2005 Citizen Informant DH was interviewed by Agent Anderson and your Affiant. She indicated that she remembers Chris, Rucker Leifson, and Tim Olsen coming by after dark to get flash lights to look for Kiplyn Davis up Spanish Fork Canyon around the time she was reported missing.
18. In August, 2005 Citizen Informant BW was interviewed by Agent Anderson and your Affiant. Citizen Informant BW informed Affiant that Tim Olsen and Citizen Informant GB asked where he would stash a body, and that they needed to move a girls body. He told them of a spot up Tucker. He indicated that they appeared to be in a panic when they asked him this question.
In November, 2005 Citizen Informant BW was interviewed again by Affiant. Citizen Informant BW provided additional information that the area where Kiplyn Davis was buried is called Kiplyn's Cove. Citizen Informant BW stated one year while sighting in their rifles (Citizen Informant GB and Citizen Informant BW) that Citizen Informant GB picked some flowers and put them under a cedar tree. When asked him if that was where she was, he indicated that it was. They both had the understanding that they were talking about Kiplyn Davis.
19. On September 28th, 2005 Citizen Informants AB and PB were interviewed by Agent Anderson and your Affiant. They provided that in 1997 they were over at Tim Olsen's home and while there a friend came by that resembled Kiplyn, Citizen Informant MW. Tim had stopped dating Citizen Informant MW and told Citizen Informant PB that he now knew why he couldn't keep dating her, it was because she looked like Kiplyn Davis. Citizen Informant PB later asked if he was talking about the Kiplyn Davis that had disappeared. Tim Olsen asked Citizen Informants PB and AB "what would you say if I killed her." Tim later got up, kicked some coins that they had been stacking and exclaimed, "I've killed before, I could kill again."
Citizen Informant AB informed Affiant that Tim Olsen talked about Kiplyn Davis. Tim Olsen mentioned that "THEY" had taken advantage of her, got her drunk or drugged, killed her and that she was up the canyon.
20. In September, 2005 Citizen Informant KW was telephonically interviewed by Agent Anderson. She stated that on June 26th, 2005 Tim Olsen had called her at 0300 hours and identified himself. He threatened to kill her and everyone she loved because she was no longer dating Citizen Informant JB, Tim Olsen's close friend. Tim Olsen admitted to her that he had killed before and that he wasn't afraid to kill again. He stated that now "you, your child and your new boyfriend are on my hit list."
21. In September, 2005 Citizen Informant RC was interviewed by Agent Anderson. Citizen Informant RC informed Agent Anderson that Tim Olsen admitted that he and Rucker Leifson were the last ones with Kiplyn Davis before she disappeared. Tim Olsen also admitted that he knew who did it, where it occurred, where she is now.
22. In September, 2005 Citizen Informant JB was interviewed by Agent Anderson and your Affiant. Citizen Informant JB informed Affiant that Tim Olsen admitted that the FBI was following him and that he was with Kiplyn Davis up Spanish Fork Canyon when something happened. Citizen Informant JB related an incident where Tim Olsen engaged in an argument with a neighbor and Tim Olsen stated "I've killed and I can kill again." Tim Olsen also threatened Citizen Informant JB's girlfriend over the phone (Citizen Informant KW) to kill her as she was dating someone other than Citizen Informant JB. During several times that Tim Olsen was drunk, he would say that he would rather kill himself than know the things he knows.
23. On December 8th, 2005 Citizen Informant GB was interviewed by Agent Anderson and your Affiant. Citizen Informant GB admitted that he had been to Citizen Informant DB's home where Tim Olsen admitted that he had raped and killed Kiplyn Davis. Olsen alluded to Citizen Informant GB that if he didn't keep quiet the same thing would happen to him.
24. On December 8th, 2005 Citizen Informant BF was interviewed by Agent Anderson and your Affiant. Citizen Informant BF informed Affiant that she dated Tim Olsen. While they were dating he told her that he and another friend took Kiplyn Davis up the canyon. Tim Olsen admitted to getting into a fight with Kiplyn and the other boy walked off. Tim Olsen stated that after the other male left he "took care of Kiplyn Davis."
25. In December, 2005 Agent Anderson spoke with Citizen Informant DS. Citizen Informant DS indicated that he was at a party in 1999 or 2000 where he heard Tim Olsen say "F--- that bitch. I f------ stuffed her in a truck box." He also states he heard Tim Olsen say "we just stuck her in a truck box and got rid of it."
26. At this time Timmy Brent Olsen is being held in Federal custody for perjury before a Federal Grand Jury and giving false or fictitious statements to a Federal Agent. Your Affiant respectfully requests that a Warrant of Arrest be granted for the arrest of Timmy Brent Olsen for the Murder of Kiplyn Davis.
