A former nanny already facing child sexual exploitation charges has been arrested again, accused of sexually abusing another boy.
The Utah Attorney General's Office filed another count of first-degree felony aggravated sexual abuse of a child against David Michael Busby, 27. Prosecutors have compared the case to the 1992 movie "The Hand That Rocks the Cradle," about a psychotic nanny who plots to seduce and then harm members of the family she is hired to help.
"This is a new victim," Ken Wallentine, the Utah Attorney General's chief of law enforcement, said Wednesday.
According to a probable cause statement filed in Farmington's 2nd District Court, Busby had befriended a Davis County family and often stayed at their home. In June 2002, investigators said Busby fondled a 13-year-old boy.
"(The victim) said that Busby often referred to him as 'my little brother,' " Capt. Chris Ahearn wrote in court documents. "(The victim) stated that he felt like Busby took more interest in him than he did other family members."
Investigators said Busby invited the teenage boy to visit him and even allowed the victim to drive his car when he was 14. Police said Busby developed a very close relationship with the victim's family, even living with them for a time.
"(The victim) stated that Busby would tickle him and engage in tickling his friends when they were at the house," Ahearn said.
The case is eerily similar to the one filed against Busby in February. The Utah Attorney General's Office filed 18 counts of second-degree felony sexual exploitation of a minor charges against Busby, accusing him of taking illicit pictures of a 13-year-old Salt Lake City boy he cared for as a nanny in 2002.
Prosecutors said Busby had written letters to two of the family's children, saying "I love you little brother" and encouraging the boy not to function at school and to think only about "you and me getting back together."
Upon discovering the letters, the parents obtained a protective order against Busby in 2003. He fought it all the way to the Utah Supreme Court, arguing it violated his right of free association. In 2005, the state high court denied his claims.
"I miss having you by me and being able to hold you," said another note written in 2002 by Busby and referenced in the Supreme Court decision. "I'll never give up until we're completely together again. You mean everything to me. I love you, I love you, I LOVE YOU."
Assistant Utah Attorney General Paul Amann said it appeared that Busby had been in contact with the boys from both families at the same time.
"He had been trying to insinuate himself into more than one family contemporaneously," he said Wednesday.
Investigators claimed in court documents that in 2000, Busby had inappropriate sexual contact with a child from Georgia who was vacationing with his family in Park City. Busby worked as a part-time ski instructor and was baby-sitting three children. Charges were never filed because the victim's family refused to return to Utah to testify against him, police said.
Busby was booked into the Salt Lake County Jail Tuesday where he remains on $100,000 bond. A judge revoked his bail from the Salt Lake City case because he was contacting witnesses, Amann said. Busby is scheduled to appear in 3rd District Court on April 17.
Police said they were looking for more possible victims and encouraged parents who knew Busby either when he worked as a part-time ski instructor in Park City or through church youth groups to speak to their children and come forward to authorities.
"It was partly a result of the media attention that was given to Busby's original arrest that prompted this second victim to come forward," Wallentine said Wednesday. "We certainly have reason to believe there may be others."
