A man who says he was shot five times by a security guard outside a Salt Lake City night club has sued the business for $50,000.
The personal injury suit was filed Monday in 3rd District Court by Jose A. Garcia against the El Calor Night Club, 996 S. Redwood Road. It concerns a fight that occurred outside the club the morning of April 23.
Garcia was involved in the altercation, which started inside the club. Security guards escorted the fighters outside, then the fighters removed their belts and started hitting the guards with them, police told the Deseret Morning News at the time.
According to documents filed Tuesday by Garcia, he was shot while trying to leave the club's parking lot. He was hit in the chest, back and left arm, and also suffered a broken nose and head wounds.
A 40-year-old security guard was booked that night and subsequently charged with five counts of aggravated assault. He has pleaded not guilty on all counts but has not yet been tried.
Garcia claims in the documents that the night club was negligent in its hiring and supervising of its security guards. The guards should have been better trained concerning the use of deadly force and the club should have ensured the guards were legally allowed to carry guns inside the club, the suit states.
Garcia and his attorney, Salt Lake City-based Richard C. Dribble, have asked for a jury trial. Their case is scheduled to be heard before Judge Vernice Trease.
