Third District Judge Denise Lindberg originally granted a motion to allow a man charged with attempted murder to leave jail temporarily to attend the funeral of his sister.

On Thursday, she changed her mind.

Lindberg had accepted a request Tuesday from defense attorneys for Julio Martinez to be released from jail to attend the funeral of his sister, Veronica Martinez. She was killed in a Magna crash on July 18, along with five other people.

Julio Martinez is charged with one count of attempted murder, a first degree felony, for allegedly stabbing his wife with a pair of scissors more than 20 times while their two children were present, according to charges filed in 3rd District Court. He was also charged with one count of robbery, a second-degree felony, and two counts of domestic violence in the presence of a child, a third-degree felony.

At the request of prosecutor Greg Ferbrache, Lindberg retracted her original decision on Thursday and denied the request out of respect for the alleged victims — the man's wife and children, she said. Julio Martinez's wife was expected to attend the funeral and at least one of Julio Martinez's children was expected to serve as a pallbearer, said victim advocate Brandon Simmons.

"Mr. Ramirez will have to pay his respects in his own way," Lindberg said.
