FARMINGTON — A former Davis High School teacher already awaiting trial for allegedly having sex with two teenage boys has been charged again with unlawful sexual activity with a minor while out on bail.
But defense attorney Ed Brass says the case filed Tuesday in Farmington's 2nd District Court against his client, Brianne Land Altice, 35, does not constitute a new victim.
Altice, who used to teach English at Davis High, was originally charged in December 2013. In December 2014, prosecutors amended the original charge to include a third alleged victim.
But because the activity with the third teen allegedly happened when Altice was no longer a teacher, prosecutors have now decided to file it as a separate case.
Altice was charged Tuesday with three counts of unlawful sexual activity with a minor and one count of dealing in harmful materials to a minor. All charges are third-degree felonies.
According to the newly filed charges, between Nov. 1, 2013, and Aug. 25, 2014, after Altice had been charged the first time, she engaged in sexual intercourse with a 17-year-old boy. She also sent the boy "a text message with a photograph of her bare breasts," the charges state.
Altice was already accused of having sex with another 17-year-old boy between April 1 and June 30, 2013, as well as with a 16-year-old student between January and June 2013.
The new charges bring her to a total of three alleged victims, five counts of rape, a first-degree felony; two counts of forcible sodomy, a first-degree felony; three counts of forcible sexual abuse, a second-degree felony; three counts of unlawful sexual activity with a minor, a third-degree felony; and one count of dealing in harmful materials to a minor, a third-degree felony.
An arrest warrant was issued for Altice on Wednesday. Prosecutors originally asked for a no-bail warrant. She was booked into the Weber County Jail and posted a $10,000 bond Thursday, according to court records.
A preliminary hearing for her other case was scheduled to begin next week.
