A former Brigham Young University football player, found guilty last month of two counts of unlawful sexual intercourse with a 15-year-old Orem girl, will serve 60 days in the Utah County Jail.
Wayman Hamilton, 28, could have received up to five years in prison on each of the third-degree felony counts. However, 4th District Judge Boyd L. Park agreed to sentence him as if he had been found guilty of Class A misdemeanors - the next lowest sentencing category.Park gave Hamilton two suspended jail sentences of one year each but ordered that he spend 60 days in jail as a term of probation, which will last 36 months. Park, who rejected a defense motion to arrest judgment, also granted the defendant work release and time to search for a job.
Hamilton, who has been employed in California, also must pay a fine of $1,000 or complete 200 hours of community service and pay $250 to the victim's reparation fund. In addition, Park ordered him to undergo either outpatient counseling or sexual-abuse therapy, and instructed him to have no unsupervised contact with any females under 18.
The charges stem from incidents that occurred June 3, 1988, and Aug. 26, 1988, at Hamilton's Orem home. In Utah, the legal age of consent is 16.
The defendant played football for BYU from 1980-83 and was named to the second team all-WAC in 1981, when he led the conference in scoring.
