Intermountain Health Care's decision to buy the Bryner Clinic in Salt Lake City means Utah Supreme Court Justice Christine Durham will no longer hear any IHC cases.

Durham wrote the 1985 court opinion that outlined standards IHC must meet in order to qualify as a charitable institution exempt from property tax."I have been subjected to a lot of hostile comments from IHC employees" since the ruling, Durham said.

So the company may be pleased with Durham's decision to recuse herself from all future IHC cases.

Durham's husband, Dr. George Durham, is a pediatrician at the Bryner Clinic.

"When my husband becomes a full-time IHC employee after Jan. 1, I will automatically recuse in any of their cases because of the appearance issue," she told the Deseret News.
