A lawsuit filed by a man in federal court in Southern California against HomeTown Buffet Inc., a subsidiary of Summit Family Restaurants, formerly JB's Restaurants, has been dismissed without prejudice and no money paid by either party.

The suit was filed in October 1994 by a man who held 250 shares of HomeTown Buffet stock and said there were securities law violations in connection with the sale of some HomeTown stock between the period of Oct. 12, 1993, and Sept. 28, 1994.JB's Restaurants was one of the selling shareholders of HomeTown Buffet stock in a public offering that was effective March 24, 1994, according to Don M. McComas, Summit president.
