A judge in Los Angeles on Thursday refused to dismiss Ricardo Montalban's lawsuit against Columbia Pictures over proceeds from television's "Fantasy Island."Montalban, 75, says the studio denied him 5 percent of the show's net profits.
Montalban's lawyers also are trying to begin the trial in January instead of April because of the actor's age and failing health. The judge didn't immediately rule on that request.

Montalban starred in the show from 1978 to 1984 as island host Mr. Roarke, whose sidekick Tattoo would shout "The plane, the plane!" to announce the arrival of guests.
