An Ada County grand jury has indicted Kerry S. Thomas on a charge of knowingly exposing a Boise man to the AIDS virus.

At the time of the alleged crime, Thomas, 32, was on parole from prison following his conviction on similar charges six years ago.Thomas was appointed a public defender at a Friday arraignment. He is scheduled to enter a plea Monday before 4th District Judge Deborah Bail.

Thomas is accused of engaging in sex around April 24, knowing he was infected with the virus that causes acquired immune deficiency syndrome.

The victim was a 32-year-old Boise man identified only by his initials in the prosecutor's complaint. Thomas faces up to 15 years in prison and a $5,000 fine.

In a 1990 plea bargain with Ada County prosecutors, the former Boise State basketball player dodged charges he knowingly attempted to pass on HIV to five female victims.

Then, after being convicted on a single charge of statutory rape involving one of the women, a 16-year-old, he persuaded an Ada County judge to cut his sentence in half.
