Pictures of Brad Pitt in the buff two years ago weren't news then and they sure aren't news now.
John Lavely, the actor's lawyer, argued the point Tuesday as part of the actor's push to ban sales of the August issue of Playgirl. It carries the 1995 nude photos of Pitt with then-girlfriend Gwyneth Paltrow."There is no newsworthiness to these photos," Lavely said. "It was simply an attempt to use them to sell magazines."
The judge left in place a temporary restraining order until he decides whether to make the order permanent.
Playgirl lawyer Kent Raygor has argued that publication of the photos is a First Amendment matter.
