A 9-year-old boy and his teenage brother were charged Thursday with the murder of a 5-year-old foster child in their family's care, prosecutors said.
The victim, David Jones, died on Sunday from swelling of the brain after being beaten with a belt and the fists of the two brothers, investigators said."This child was beaten to death," Cook County Assistant Prosecutor Kip Owen told reporters.
An attorney for the brothers, the older of whom is 14, said murder charges were not warranted because there was no intent to kill the boy.
