Third District Judge Judith Atherton dismissed two felony charges against a man allegedly involved in the sexual assault and severe beating of a woman last summer, but he still faces two other felony charges.

Silvester Eugene Harloo, 19, originally was charged with attempted murder and aggravated assault, both first-degree felonies.

After a preliminary hearing Thursday in which the victim was the sole witness, Atherton dismissed those two charges, but Harloo still faces two counts of aggravated sexual assault, also a first-degree felony.

Nathan Redcap faces two counts of aggravated sexual assault and one count of attempted murder, all first-degree felonies. Redcap, 17, is being tried in adult court.

The third unidentified juvenile male was not in court.

Harloo and Redcap sat together as the victim testified that while staying in motel on Aug. 13 she encountered two men who invited her and her friends to a party in their motel room, she testified.

Harloo "seemed nice" and she said she enjoyed his company. She said Harloo did not beat her but he did hold down her hand while Redcap and the other juvenile male attacked her after other guests had left the party. During the beating, the men jumped off the bed onto her and kicked her in the face, she said. She said she heard them asking if she was dead. "I thought they were going to kill me," she said, sobbing. "They kept stomping on me."

Atherton set a Nov. 9 scheduling conference for Harloo and Redcap.
